By using
a TELMEX Traveler Phone Card or TELMEX Virtual
Traveler Phone Card, you accept the TERMS
& CONDITIONS listed below:
1. TELMEX
Traveler Phone Cards and TELMEX Virtual Traveler
Phone Cards (collectively "Phone Cards") can
only be used for calling from Mexico to other
destinations. Phone Cards cannot be used for
placing calls originating anywhere outside
Mexico.
2. For
operator assistance while in Mexico, card
users should contact the TELMEX Customer Service
Department in Mexico at: 01-800-123-0303.
For ordering or payment issues, TELMEX USA's
toll free number in the United States: 1-800-678-5443
should be used.
3. If
TELMEX Virtual Traveler Phone Cards ordered
through www.telmexusa.com are not received
within thirty (30) minutes, the Customer should
contact TELMEX USA (1-800-678-5443) no later
than fifteen (15) days after placing their
order.
4. In
the event that Phone Cards are lost, stolen,
or destroyed after delivery to the Customer,
the Customer will be directly responsible
for the losses incurred. TELMEX USA will not
provide credits or refunds (in any form or
amount) for lost, stolen, misused, or unused
Phone Cards. If a Phone Card is defective,
the customer should contact TELMEX USA at
1-800-678-5443 for a replacement
card.
5. Service
is provided by Teléfonos de México, S.A. de
C.V. ("TELMEX").
6. TELMEX
USA reserves the right to cancel Phone Cards
if it is notified by TELMEX that there are
technical problems, and to replace them with
new Phone Cards within ten (10) days.
7. TELMEX
USA makes no warranty, express or implied,
regarding the condition(s) or fitness of the
services offered for any particular use or
purpose. As permitted by law, the liability
of TELMEX USA shall be limited to direct damages
for any personal or property injury, and for
all other claims to an amount equal to the
charge for the affected service(s). IN NO
EVENT WILL TELMEX USA, ITS EMPLOYEES, AGENTS
OR ANY COOPERATING SERVICE PROVIDER(S) BE
LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT,
RELIANCE, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
8. The
Customer and TELMEX USA agree that the exclusive
remedy for all disputes arising out of purchase
or use of Phone Cards, except for matters
taken by the Customer to small claims court,
is arbitration by an independent arbitrator.
DISPUTES WILL NOT BE HEARD BY A JURY OR IN
COURT AND MAY NOT BE MADE PART OF A CLASS
ACTION.
9. Phone
Card service may be suspended or terminated
without notice if TELMEX USA reasonably suspects
fraudulent use of Phone Cards.
10. Calls
are billed in one-minute increments with partially-used
minutes rounded up to the next full minute.
11. Rates
are subject to change without notice. For
